Enbridge Hearings to the NEB Panel Must Be Canceled

The question is relevant, for if you, I or any entity was say, applying to be a ferry operator, if all our vessels we operated in the past were lying on the bottom of the ocean, burnt to a crisp and or taking on water would we not be laughed out of the bidding process?

According to Wikipedia, and not denied by Enbridge, in the last 10 years Enbridge has had nearly 1000 major oil spills...

Using data from Enbridge's own reports, the Polaris Institute calculated that 804 spills occurred on Enbridge pipelines between 1999 and 2010. These spills released approximately 168,645 barrels (26,812.4 m3) of crude oil into the environment.[12]
On July 4, 2002 an Enbridge pipeline ruptured in a marsh near the town of Cohasset, Minnesota in Itasca County, spilling 6,000 barrels (950 m3) of crude oil. In an attempt to keep the oil from contaminating the Mississippi River, the Minnesota Department of Natural Resources set a controlled burn that lasted for 1 day and created a smoke plume about 1-mile (1.6 km) high and 5 miles (8.0 km) long.[13]
In 2006, there were 67 reportable spills totaling 5,663 barrels (900.3 m3) on Enbridge's energy and transportation and distribution system; in 2007, there were 65 reportable spills totaling 13,777 barrels (2,190.4 m3) [14]
On March 18, 2006, approximately 613 barrels (97.5 m3) of crude oil were released when a pump failed at Enbridge's Willmar terminal in Saskatchewan.[15] According to Enbridge, roughly half the oil was recovered.
On January 1, 2007 an Enbridge pipeline that runs from Superior, Wisconsin to near Whitewater, Wisconsin cracked open and spilled ~50,000 US gallons (190 m3) of crude oil onto farmland and into a drainage ditch.[16] The same pipeline was struck by construction crews on February 2, 2007, in Rusk County, Wisconsin, spilling ~201,000 US gallons (760 m3) of crude, of which only about 87,000 gallons were recovered. Some of the oil filled a hole more than 20 feet (6.1 m) deep and contaminated the local water table.[17][18]
In April 2007, roughly 6,227 barrels (990.0 m3) of crude oil spilled into a field downstream of an Enbridge pumping station near Glenavon, Saskatchewan.[15]
In 2009, Enbridge Energy Partners, a US affiliate of Enbridge Inc., agreed to pay $1.1 million to settle a lawsuit brought against the company by the state of Wisconsin for 545 environmental violations.[19] In a news release from Wisconsin's Department of Justice, Attorney General J.B. Van Hollen said "...the incidents of violation were numerous and widespread, and resulted in impacts to the streams and wetlands throughout the various watersheds."[20] The violations were incurred while building portions of the company's Southern Access pipeline, a project to transport crude from the oil sands region in Alberta to Chicago.
In January 2009 an Enbridge pipeline leaked about 4,000 barrels (640 m3) of oil southeast of Fort McMurray at the company's Cheecham Terminal tank farm. Most of the spilled oil was contained within berms but about 1% of the oil, about 40 barrels (6.4 m3), sprayed into the air and coated nearby snow and trees.[21]
On January 2, 2010, Enbridge's Line 2 ruptured near Neche, North Dakota, releasing about 3,784 barrels of crude oil, of which only 2,237 barrels of were recovered.[22][18]
April 2010 an Enbridge pipeline ruptured spilling more than 9.5 barrels (1.51 m3) of oil in Virden, Manitoba, which leaked into the Boghill Creek which eventually connects to the Assiniboine River.

Then in July 2010...

July 2010, a leaking pipeline spilled an estimated 843,444 US gallons (3,192.78 m3) of crude oil into Talmadge Creek leading to the Kalamazoo River in southwest Michigan on Monday, July 26 near Marshall, Michigan.[24][25] A United States Environmental Protection Agency update of the Kalamazoo River spill concluded the pipeline rupture "caused the largest inland oil spill in Midwest history" and reported the cost of the cleanup at $36.7 million (US) as of November 14, 2011.[24] The cleanup is unfinished as of July 2012.[26] PHMSA raised concerns in a Corrective Action Order (CAO) about numerous anomalies that had been detected on this pipeline by internal line inspection tools, yet Enbridge had failed to check a number of those anomalies in the field.[27] The Michigan spill affected more than 50 kilometres of waterways and wetlands and about 320 people reported symptoms from crude oil exposure.[28] The NTSB said at US$800 million it was the costliest onshore spill cleanup in U.S. history.[29] The NTSB found Enbridge knew of a defect in the pipeline five years before it burst.

The NTSB found that Enbridge in the Kalamazoo spill acted like "Keystone cops"

This track record of past spills and reckless disregard to human health, environment and procedure alone should have disqualified Enbridge from this proposed project, right from the very beginning, the very first day of the Enbridge review by the NEB, Enbridge had a leaking pipe in the gulf of Mexico..

" Canadian pipeline builder Enbridge reported a leak from one of its pipelines on the day public hearings began into the company’s planned Northern Gateway pipeline.

U.S. pipeline regulators told Enbridge about the possible leak. A subsequent helicopter over-flight discovered a metre-wide patch of bubbles over the company’s Stingray pipeline, which can carry 560-million cubic feet a day of natural gas from offshore wells in the Gulf of Mexico. The bubbles were found about 100 kilometres from the Louisiana coast."

Funny no?, Enbridge didn`t even know they had a leak, a helicopter reported seeing bubbles, shouldn`t this too have been enough to halt the process?

Stephen Harper could care less about the environment, a bought man, big oil makes the rules, Alberta, big oil  and China, as for human health along with a thriving environment rank dead last in Stephen Harper`s world, for what I say must be true or this review would`ve been halted last year, a tragic comedy being produced by corporate profits and directed by a corrupt Federal Conservative party..

And still the review continues, then when 400,000 litres were spilled into Alberta`s Red Deer river,..Enbridge again

"ELK POINT, Alta. - There's been another oil spill in Alberta, this time northeast of Edmonton.
The Energy Resources Conservation Board says the leak of heavy crude oil happened Monday at a pumping station on Enbridge Inc.’s (TSX:ENB) Athabasca pipeline about 24 kilometres southeast of Elk Point.
Enbridge estimates about 230,000 litres has leaked, but the ERCB's Darin Barter said Tuesday that amount hasn't been confirmed.
"It's a significant size spill," said Barter. "Any amount of crude oil out of a pipeline is significant to us. Obviously we've had a number of pipeline incidents in the past short while and we're monitoring cleanup on them and we have a number of investigations underway."

1 week later another 25,000 barrels of bitumen puked into Alberta muskeg, technology didn`t even know the oil was leaking, again it was a third party that reported the spill..

"An oil spill that went undetected for days has released 22,000 barrels of oil into northeastern Alberta’s muskeg, news sources report.

spill, an emulsion composed of oil and water, came from a waste disposal line owned by Pace Oil and Gas, and was evidently only discovered when an aircraft from another oil company made a routine flyover in the area on May 19, the Calgary Herald reports.
The spill is “among the largest in North America in recent years,” reports the Globe and Mail

Why is this NEB review of Enbridge still going on, it has been proven not by testimony, not by statistics, it`s been proven by facts on the ground, Enbridge can`t guarantee anything, their words and promises are garbage, no court no panel of intellectuals, no unbiased fact finding panel could ever green light Enbridge, the proven facts outweigh the deliberate Enbridge lies by a magnitude so large,  there has been no reason for the NEB to even remotely consider any decision but this..... "NO WAY ENBRIDGE"...

There is no justification for these hearings to continue, if you, or if any company with "that record" with ongoing scandals, lies and comedy relief, the hearings are already a mockery, a continuation of the facade only serves to prove that Canada, at least on the Federal level are wholly corporate owned and operated..

Some of you might say the word LIE is too strong, wrong, Enbridge have lied and bullied, and most worrisome for me, Enbridge has faked clean ups, or should I say, attempted clean ups of spilled oil...

In this video Enbridge has covered spilled oil with sand, that`s correct, in a watershed, Enbridge hired people to cover up spilled oil in a waterway with mounds of sand

In this next video, Enbridge covered vast grassland areas, where oil was spilled Enbridge placed a special canvas over the grass, covered the canvass with dirt and planted special grass to hide thousands of litres of spilled oil..

Is this too not enough to have the NEB reject the Enbridge pipeline proposal to Kitimat, a pipeline carrying raw bitumen which sinks in water, a substance that can`t be cleaned up once puked into waterways, a pipeline that must cross over 800 rivers and streams, a pipeline that must traverse a rugged snow-filled remote landslide prone mountain range, let me repeat, 800 plus rivers and streams, almost the entirety of British Columbia`s salmon rearing rivers put in danger with the inevitable spills....

Why has the Enbridge review not been canceled, the anti-pipeline opponents have given more than enough direct evidence to convict Enbridge of crimes, and planned future crimes..

And what of the lying, Enbridge executives have lied about support among First Nations..

Haida Nation blasts Enbridge about “deliberately misleading” info in Northern Gateway filing

Posted by:

Haida Nation President Guujaaw is making some serious allegations about “deliberately misleading and false information”

 in Enbridge Northern Gateway
documents provided to the federal Joint Review Panel which will soon commence hearings on the controversial oils sands pipeline project.

Specifically, Guujaaw rejects Enbridge’s claim that the Haida are in the process of “relationship building” with the Calgary-based company which is seeking to build an oil transmission pipeline from Alberta to the BC coast at Kitimat.

Haida have an interest in the project because oil tankers will carry oil sands crude past Haida Gwaii,

which includes a national park and designated UNESCO world heritage site.

It hasn’t been a good week for Enbridge. Earlier, a majority of Gitxsan hereditary chiefs renounced a much-trumpted profit-sharing deal with Enbridge.

Here’s an email to the Panel, which was cc’d to me on Friday by Guujaaw.

Re: statement contained in Volume 5A: Aboriginal Engagement, Appendix D: National and Regional Aboriginal Organizations.
To whom it may concern;

Enbridge has provided deliberately misleading and false information contained in their Section 52 Application claiming that the applicant has built relationships with the Haida Fisheries Program, Haida Development Corporation (sic, presumably Haida Enterprise Corporation)  and Haida Child and Family Services.

Haida Gwaii Community Futures is not an ‘Aboriginal Organization’ and has no idea how they got on the list.

Representatives of the above organizations are in no way engaged with nor have they given any reason to believe they are “relationship building” with Enbridge.

We would like to have all of these names stricken from Enbridge’s filed documents as it is libellous bringing these organizations into disrepute, not only with their own constituents, but also the many First Nations, organizations and people who are committed to the health of this planet.

President of the Haida Nation

Need more, Enbridge lied about the Gitxsan support, in an organized attempt to hoodwink British Columbians, with the Vancouver Sun, The Province, The Globe,, at the request of Enbridge executives the mainstream media ran stories on the front pages across Canada claiming Enbridge has First Nation support, when in fact Enbridge bribed two people of First Nation pedigree, two people who had no authority to sign anything, the two people have now been stripped of all standing, it was a ploy right out of Goebel`s playbook, circa 1940s

Gitxsan-Enbridge Deal is Null and Void(Breaking News)UPDATED

Breaking News, the majority of Hereditary Chiefs have voted and the Gitxsan-Enbridge equity deal is null and void...

And there is more, the Gitxsan treat Society members who inked this deal in secrecy and against the wishes of almost 100% of the Gitxsan Nation have been fired..

Here is the official release...

Gitxsan Unity Movement Press Release

Gitinmaax, B.C.

December 19, 2011

Majority of Gitxsan Chiefs confirm the shut sown of the Gitxsan Treaty society(GTS)

The majority of Gitxsan hereditary chiefs have put into writing their decision to shut down the Gitxsan Treat society(GTS). The Chiefs are supported by their houses and clans, and made this decision only after holding clan meetings. The decision to shut down the GTS and fire senior staff was made because the GTS was making decisions without consultation and against the will of Gitxsan houses and Clans.

The society was shut down on December 5th after Chiefs consulted with their clan members, Presently, 42 hereditary Chiefs (Two thirds of hereditary Chiefs) have signed a declaration stating the following.

  • The Enbridge Northern Gateway Pipeline Agreement is null and void;

  • The GTS no longer exists so it must cease operations and shut down;

  • The former executive director, and former Chief negotiator and negotiator are terminated;

  • That all other staff be given notice of indeterminate lay-off;

  • And, all Pdeek representatives(GTS board members) are recalled.

The Gitxsan Chiefs are conducting on online poll to determine support levels in Gitxsan membership for the deal with Enbridge, preliminary results show that over

90% of Gitxsan people are against the proposed pipeline. Almost 100% are against the Gitxsan-Enbridge deal that was signed on December 2nd.

A petition is underway too, Volunteers collecting petitions against Enbridge have collected over 1000 signatures(600 Gitxsan, 400 supporters) and phone numbers since December 6th.

Gitxsan hereditary Chiefs note that the fired staff of the GTS continues to speak publicly and act against the wishes of the Gitxsan Chiefs and members. These staff members are the Executive Director, Negotiator, and Chief Negotiator. The Gitxsan Chiefs emphasize that the Gitxsan Treaty Society and these former staff members do not represent the Gitxsan people.

Former staff who continue to spend money from GTS accounts, will cease their activity and respect the will of the Chiefs and members. Their actions paying high-priced lawyers from GTS funds to sue their own Chiefs and members. This is further evidence of the complete lack of respect this office has towards Hereditary Chiefs who they claim to represent. The Gitxsan seek to settle this matter through their own law, the Gitxsan Ayookw, and wish to point out that remedies exist in Gitxsan law for those that bring harm upon the Nation. Therefore, in this matter, The Gitxsan hereditary Chiefs have exercised the Gitxsan Ayookw, the foundation of Gitxsan society and culture for millennia .

The Gitxsan Unity Movement began as Gitxsan against Enbridge in early December. The goal of the movement is to bring harmony between the Gitxsan Government and values, law, and will of the Gitxsan. The Chiefs shut down the GTS on December 5th because they were acting contrary to Gitxsan laws and value. The Gitxsan Unity Movement is 100% volunteer driven, with Gitxsan hereditary Chiefs and members in the best interest of our land, culture, and people.

Enbridge has been caught super inflating the economic numbers and underestimating the environmental costs too..

"Enbridge's Northern Gateway benefits questioned at hearing"

"That's different than what Enbridge is telling its own investors and shareholders, said Boye. The company's own estimate is 4.4 per cent growth — a difference of 500,000 barrels a day by 2020 that leads to a corresponding drop in revenues earned by producers.

"Have you given a different supply forecast to your shareholders than that provided to the panel?" Boye asked Enbridge's Gateway manager John Carruthers on Tuesday.
Carruthers acknowledged that different figures have been used at different times. Estimates can vary depending on assumptions of what the mix of varying crudes would be, he said.
"There would be times when we would see differences."
But the variances aren't big enough to change the project's economics, Carruthers said.
"The minor changes over time don't change the project need."
Boye added that the project could discourage the upgrading of oilsands bitumen in Alberta and that its cost to the environment hasn't been fully evaluated.
She pressed Enbridge over the use of diluent — lightweight solvents mixed with bitumen or other heavy crudes to make them flow through a pipe. Although the mix varies, roughly one-third of what would flow through the Gateway line would be diluent. The Gateway project includes a second pipeline that would import diluent from the B.C. coast back to Alberta.
Boye suggested the cost of that diluent has not been factored into calculations of producer benefit.
Ignoring the cost of diluent exaggerates the case for shipping raw bitumen outside Alberta for upgrading or refining, said Robyn Allan, an analyst for the Alberta Federation of Labour, who is advising the Haisla.
"There is no economic analysis ... that's been supplied to the hearings (of the impact) to the Canadian economy when we import condensate instead of upgrading in Alberta," she said outside the hearing"

Enbridge lies in their animated ads promoting the project, they omitted narrow channels, removed islands, an animated depiction, pastel colours and soothing music, in hindsight I say the ads were ironically perfect, they were as cartoon like as the proposal itself, and that`s exactly the way Enbridge has acted, like cartoon characters, like the wiley Coyote using his box of ACME roadrunner catching devices...

Why haven`t the NEB hearings been canceled, the panel must reject the project on past history alone...

Let me recap, Enbridge has had over 1000 major oil spills in the last decade, they have been caught over and over again hiding oil, hiding oil they spilled with sand, with canvass, with special grasses, they have been caught hiding oil they can`t clean up, ..Enbridge has been described as acting like "Keystone cops" by the NTSB, ..

Enbridge has been caught lying about the Haisla First Nation support, Enbridge have been caught bribing Gitxsan members to sign equity deals when said members had no authority, Enbridge has persuaded the mainstream media to ink articles, place them on the front pages of Canada`s major newspapers, stories made up out of whole cloth, to this day Enbridge refuses to name which First Nations have signed equity deals, from what I heard only a couple have signed whose territory is over 1000 miles away from the Gateway pipeline..

Enbridge has been caught submitting an exaggerated set of economic numbers to the NEB panel yet at the same time Enbridge gave a completely different(smaller, less exaggerated) set of numbers to their own shareholders, as you know, it`s a crime to lie to shareholders, Enbridge doesn`t hold that much respect for the NEB panel reviewing this project..

Enbridge offered a cheap pipeline for $5 billion dollars, after recent spills Enbridge claims they will "now"spend an "extra" $500 million on the pipeline to make it safer,  yet industry experts put the price of a safe(r) pipeline through this remote, rugged mountain range at $16 to $20 billion dollars..The fact Enbridge used the cheaper pipeline from the git-go should disqualify them too..

Enbridge has spent 10`s of $millions throughout British Columbia`s mainstream media on cartoon ads devoid of facts, ...How come any adverting at all is even allowed while the review is taking place, are jurors allowed to watch advertisements placed by gangsters that are currently on trial?...Ads should be prohibited, the three person NEB panel should be removed from the hearings if they have seen the ads...

Cartoon ads devoid of facts, big old whopper tales(lies) over the amount of long-term jobs, complete incompetence demonstrated by Enbridge over and over again, hiding oil, intimidating affected residents of Michigan over the Kalamazoo spill, caught hiding oil, caught bribing First Nations, lying about First Nation support, lying about the environmental risks, lying about the ability to clean up bitumen spilled in water,

Lies, bribery, incompetence, intimidation, with a track record of oil spills, destroyed environments, faulty pipes, even after pipe inspectors warned of inevitable spills Enbridge refused to replace old pipes, for it`s cheaper for Enbridge to bribe, hide oil with grass, with sand, to cover up and buy out the locals then to actually do due diligence..

So I have one burning question to Stephen treason Harper and the NEB panel.

Why haven`t the Enbridge Northern Gateway Pipeline hearings been canceled?..

Cheers Eyes Wide Open

Harper has said, the Embridge pipeline, will be judged by science and not politics. Problem is, Harper got rid of Canada's top Scientists. These scientists are Harper's. We already know in advance, what Harper's scientists will report. We all know of Harper's dirty tactics and his cheating to win.

Honesty? I doubt that very much, especially when it comes to Harper? Harper doesn't know the meaning of the word, honest.

BC has no say over Alberta, nor their citizens. What right does Alberta have, to dictate to BC and our people? Premier Redford behaves as though, it is her God given right, to force her dirty Bitumen, onto our BC province and our citizens.
